Petiki Terms of Use

These Terms of Use ("Terms") are an agreement between you and [Ad Soyad ya da şirket unvanı] ("Petiki", "we") for the Petiki mobile app and related services (the "Service"). You accept these Terms by ticking the consent box and tapping "Accept and continue" when you first open the app; the version you accepted and the time are recorded. If you do not accept them, do not use Petiki. This English text is a translation; if it conflicts with the Turkish version, the Turkish version prevails to the extent permitted by law.

The Subscription Terms also apply to subscriptions. How we process personal data is described in the Privacy Policy.

1. What is Petiki?

Petiki is a productivity app that helps you track tasks, habits and focus time while you feed and raise a virtual pet. Petiki is not a medical, psychological or other professional service.

2. Minimum age and parental permission

  1. You must be at least 13 years old to use Petiki.
  2. If you are under 18, you may use Petiki, and in particular make in-app purchases, only with the permission of a parent or legal guardian. By tapping accept, you confirm you have that permission.
  3. If we learn that a child under 13 uses Petiki, we delete the account and its data. Parents can contact us at support@petiki.co.
  4. Store purchase controls (Apple "Ask to Buy", Google Play parental approval, etc.) are governed by the respective store.

3. Account

  1. Guest account: You can use Petiki without creating an account. Guest data is stored on your device and on our servers under an identifier tied to your device. If you delete the app or lose your device, you may lose access to guest data.
  2. Linked account: You can link your account with Sign in with Apple or Google so your data is available on other devices. Linking is optional and is not required to make purchases.
  3. Merging: If, while using a guest account, you sign in to an account you linked earlier, you choose to move the guest data into that account or to discard it. If you discard it, the guest's tasks, pets and coins (including purchased coins) are deleted; your Plus subscription and purchase records are moved to your account. Coins earned from tasks and focus are moved into an account by only one merge within 7 days; later merges in the same week move your data and purchased coins, but not earned coins.
  4. You are responsible for the security of your account, device and Apple/Google account.
  5. You can delete your account at any time in Settings > Legal and privacy > Delete my account or via the account deletion page.

4. Virtual items: coins, potions, eggs and items

  1. Coins, potions, eggs, pets, accessories and other virtual items ("Virtual Items") are a personal, non-transferable, revocable licence to use them inside the app only. You do not acquire ownership of them.
  2. Virtual Items have no real-money value; they cannot be exchanged for cash, transferred to another user, sold or used outside Petiki.
  3. You can earn coins by completing tasks, focusing, streak rewards, Petiki Plus or by buying them with real money. Earning rules (including daily limits) and prices may change for game balance. We announce significant changes in the app; changes do not take away Virtual Items already delivered to your account.
  4. Potions: the Focus potion doubles focus coins for 24 hours and the Abundance potion triples them; the daily focus-coin limit stays the same and if both are active the larger multiplier applies. Petiki does not sell randomised rewards (loot boxes, spins, etc.) for real money.
  5. We may correct or remove Virtual Items obtained through bugs, cheating, automation or refunds. For example, if the store refunds a purchase, the coins and potions granted by it are removed.
  6. When your account is deleted, your Virtual Items are permanently deleted and not refunded (store refund policies remain applicable).

5. In-app purchases

  1. All real-money purchases are made through the Apple App Store or Google Play using the store's payment system. We never receive your card or payment details.
  2. Prices are shown on the purchase screen in the currency and with the taxes shown by the store.
  3. Purchased coins and potions are added after the store confirms payment and our server verifies the purchase. If the connection fails, verification is retried later.
  4. Right of withdrawal: coins and potions are digital content delivered to your account immediately at your request. Where the law allows, the right of withdrawal does not apply once delivery has begun with your consent (for Turkey: Distance Contracts Regulation art. 15/1-ğ). This does not affect your rights if the content is defective or not delivered.
  5. Refunds: refunds are handled by the store: Apple at reportaproblem.apple.com, Google Play via its refund request page. You can also write to us at support@petiki.co.
  6. Restore: subscriptions can be restored with the same store account using "Restore purchases". Consumables (coins, potions) cannot be restored by the store; they are kept in your Petiki account, so we recommend linking your account to protect them.

6. Acceptable use

You agree not to: abuse the app, our servers or other users; attempt to bypass security or reverse engineer the app (except where the law expressly allows); use bots, scripts, clock manipulation, emulator farms or bug exploits to earn coins or rewards; buy or sell Virtual Items or accounts; use Petiki for unlawful purposes; or enter content that is unlawful or infringes others' rights in task titles and notes.

If you breach these rules we may correct the relevant Virtual Items, suspend your account or, for serious breaches, terminate it. Where possible we warn you first.

7. Your content

Your tasks, categories, notes and pet names belong to you. We process them only to provide the Service (storing, syncing between your devices, backing up and showing them to you); we do not share them or use them for advertising. You can export or delete your data in the app at any time.

8. Intellectual property

Petiki's name, logo, characters (Tiki and the other pets), artwork, animations, texts, software and design belong to [Ad Soyad ya da şirket unvanı] or its licensors. We grant you a non-exclusive, non-transferable, revocable licence to use Petiki on your own devices for personal, non-commercial purposes. No other rights are granted.

9. Changes to the Service

We may change, add or remove features. We make reasonable efforts to keep the Service available but outages may occur. If we decide to shut down the Service we will announce it in the app at least 30 days in advance, stop renewals of active subscriptions and give you time to export your data.

10. Notifications

Petiki may send service notifications such as focus timers, reminders, your pet being hungry or your streak ending. You can control device notifications in your OS settings, and server reminder notifications and promotional notifications separately in Settings > Notifications. Promotional notifications are sent only with your explicit consent.

11. Liability

Petiki is provided "as is" and does not guarantee any particular result. To the extent permitted by law we are not liable for indirect damages, loss of profit or damages caused by you or third parties; liability for intent and gross negligence is not excluded. Your mandatory consumer rights are not limited by these Terms.

12. Termination

This agreement ends when you delete your account. We may close accounts for serious or repeated breaches. Deleting your account does not cancel an active subscription; cancel it separately in your store subscription settings.

13. Changes to these Terms

We may update these Terms. For material changes we notify you in the app before they take effect and ask you to accept the new version; the accepted version and time are recorded. If you do not accept, you can delete your account.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. Consumer disputes are heard by Consumer Arbitration Committees within the monetary limits set annually and by Consumer Courts above them; if you live in another country, the mandatory consumer protection rules and courts of your country of residence remain available to you. For non-consumers, the courts of Istanbul (Central) have jurisdiction.

15. Additional terms for Apple and Google

If you downloaded Petiki from the Apple App Store: (1) these Terms are between you and [Ad Soyad ya da şirket unvanı], not Apple, and we, not Apple, are responsible for Petiki and its content; (2) the licence is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service (including Family Sharing); (3) Apple has no obligation to provide maintenance or support; (4) if Petiki fails to conform to any applicable warranty you may notify Apple and Apple will refund the purchase price, if any, and to the maximum extent permitted by law Apple has no other warranty obligation; (5) we, not Apple, are responsible for addressing any claims relating to Petiki, including product liability, legal or regulatory compliance and consumer protection claims; (6) we, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party intellectual property infringement claim; (7) you confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties; (8) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded Petiki from Google Play, the Google Play Terms of Service also apply and prevail for payments and refunds.
